Commission Implementing Regulation (EU) 2026/1968 of 7 September 2026 renewing the approval of the active substance phosphine in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council, and amending Commission Implementing Regulation (EU) No 540/2011
Phosphine's EU approval as a plant protection active substance is renewed from 1 October 2026, replacing the current approval (listed as "phosphane") that would otherwise expire 15 March 2027, but subject to strict new conditions: fumigation only in gas-tight chambers supplied from outside, post-fumigation capture by filter technology, a 0.01 ppm safety-zone limit, and a confirmatory genotoxicity data requirement. Continued authorisation of phosphine-based fumigant products in any Member State now turns on whether those products' labels and use conditions satisfy each of those annexe requirements.
